DARDEN, Judge.

STATEMENT OF THE CASE

Sally McCarty, Commissioner of the Indiana Department of Insurance, as administrator of the Indiana Patient's Compensation Fund (the "Fund"), appeals the trial court's judgment in favor of Frank Walsko.1

We reverse.
