Fernando Lindo appeals his conviction for the aggravated battery1 of his five-week-old son by shaking him and causing brain damage. He contends the trial court erred by refusing to accept his waiver of his right to a jury trial, by giving an erroneous jury charge on the intent required to commit the crime, and by denying his motion for a directed verdict of acquittal.
