¶ 1. Marshaun Stewart was convicted in August 1983 of two charges of rape and one charge of burglary and was sentenced to a term of forty-five years in the custody of the Mississippi Department of Corrections. In March 2004, he filed a "Petition for Writ of Habeas Corpus" in Coahoma County Circuit Court, which the court treated as a motion for post-conviction relief and summarily dismissed.
