Pending before the Court are Plaintiff's motion for summary judgment and Defendant's cross-motion for summary judgment. Dkt. ## 20, 28. The parties have Med responses to the motions and Plaintiff has filed a reply. Dkt. ## 27, 31. For the reasons set forth below, the Court will grant Plaintiff's motion and deny Defendant's cross-motion.
