This matter comes before the Court on Defendant Pote Concrete Contractors, Inc.'s ("Pote") Fed.R.Civ.P. 12(b)(6) motion to dismiss for failure to state a claim. Plaintiff Fletcher-Harlee Corporation brought this cause of action for breach of contract and promissory estoppel.
