FACTS AND PROCEDURAL HISTORY

¶ 1. The Merchant and Farmers Bank in Philadelphia opened at 8:30 the morning of March 12, 2004, and lead teller Felicia Cook assisted Leigh Ann Fortenberry, her first customer of the day, without incident. While Cook was assisting Fortenberry, Cozell Lyons entered the bank sporting a pair of purple sunglasses.
