Petitioner was convicted in 1995 of attempted burglary in the second degree after he unlawfully entered the home of a 94-year-old woman for the purpose of taking money and jewelry. He was on parole at the time. Petitioner was sentenced as a persistent violent felony offender to six years to life in prison.
