Defendant, Leavell D. Allen, was charged with unlawful delivery of a controlled substance for delivering 1 gram or more but less than 15 grams of heroin (720 ILCS 570/401(c)(1) (West 2002)). Defendant pleaded not guilty but was convicted in May 2005 after a jury trial. The trial court sentenced defendant to a 12-year prison term. He appeals. We affirm in part, vacate...
