OPINION AND ORDER

HARMON, District Judge.

Pending before the Court in the above referenced cause is Barclays PLC, Barclays Bank PLC, and Barclays Capital, Inc.'s (collectively, "Barclays'") motion for partial judgment on the pleadings (instrument # 3615), asking the Court to dismiss with prejudice Plaintiffs' first claim for relief against Barclays for violations of Sections 10(b)
