Defendant was charged with promoting prison contraband in the first degree after he allegedly was seen striking at another inmate with a shank during an altercation and a shank was then found on the floor. Defendant pleaded guilty to attempted promoting prison contraband in the first degree. Before sentencing, however, defendant moved to withdraw his plea on the ground that his counsel had misinformed him that no exculpatory evidence existed in a taped statement...
