On July 23, 2003, Richard M. Oehler (hereinafter referred to as defendant) pleaded guilty to one count of driving while intoxicated, as a class D felony. On October 27, 2003, defendant was sentenced to five years' probation, in addition to a $2,000 fine and mandatory court surcharge.
