Court of Appeals of Oregon.

Decided September 27, 2006.

Attorney(s) appearing for the Case

Dianna J. Gentry argued the cause and filed the brief for appellant.

Eric D. Wilson, Assistant Attorney General, argued the cause for respondent. With him on the brief were Hardy Myers, Attorney General, and Mary H. Williams, Solicitor General.

Before EDMONDS, P.J., and BREWER, Chief Judge, and ARMSTRONG, Judge.

ARMSTRONG, J.

Appellant appeals an involuntary commitment order. ORS 426.130(1)(b)(C). He appeals the commitment on the grounds that the state failed to prove two required conditions: that he is a "mentally ill person," ORS 426.005(1)(d)(A), and that he would not voluntarily participate in treatment, ORS 426.130(1)(b)(A). On de novo review, State v. O'Neill, 274 Or. 59, 61, 545 P.2d 97 (1976), we affirm.
