On the morning of the second day of jury selection, defendant executed a "plea and cooperation agreement" pursuant to which he would plead guilty to manslaughter in the first degree in full satisfaction of a three-count indictment charging him with murder in the second degree, manslaughter in the first degree and gang assault in the first degree. Paragraph 2 (b) of the agreement provided: "At the time of the plea, [defendant] shall waive all right of appeal...
