I. INTRODUCTION

This is a patent infringement case. Ciba Specialty Chemicals Corp. ("Ciba") has sued Hercules, Inc. ("Hercules") and Cytec Industries, Inc. ("Cytec") (collectively "Defendants"), alleging infringement of two patents: U.S. Patent Nos. 5,167,766 (issued Dec. 1, 1992) (the "'766 patent") and 5,171,808 (issued Dec. 15, 1992) (the "'808 patent").
