This interlocutory appeal arises from an order of the circuit court that dismissed with prejudice counts I, II, and V of plaintiff's third-amended complaint pursuant to section 2-615 of the Code of Civil Procedure (Code) (735 ILCS 5/2-615 (West 2004)). This appeal is only with respect to the dismissal of counts I and II.
