MEMORANDUM OPINION

McHARGH, United States Magistrate Judge.

On the evening of Nov. 26, 2002, plaintiff Eddie Fair ("Fair") reported a burglary to Parma police. (Doc. 1; doe. 36, DX 4, complaint1, at ¶¶ 5-6.) Fair had just returned to Ohio from a three-day visit to his home town of Flint, Michigan.
