This matter comes before the Court upon the motion of Defendant CVS Corp. ("CVS") to dismiss the complaint brought by Plaintiff Rahim Caldwell for failure to state a claim upon which relief may be granted pursuant to Fed.R.Civ.P. 12(b)(6).
