OPINION

STAFFORD, District Judge.

Respondent, Paul Renico ("Renico"), appeals a conditional grant of habeas corpus relief to Petitioner, Alton Higgins ("Higgins"), under 28 U.S.C. § 2254. We AFFIRM.
