On order of the Court, the applications for leave to appeal the May 5, 2005 judgment of the Court of Appeals are considered and, pursuant to MCR 7.302(G)(1), in lieu of granting leave to appeal, we VACATE that judgment and the June 24, 2004 Court of Appeals judgment, and we REMAND this case to the Court of Appeals for reconsideration in light of National Wildlife Federation v. Cleveland Cliffs Iron Co.,
