In this prosecution and conviction for abusive sexual contact with a minor in violation of 18 U.S.C. § 2244(a)(3), defendant's post-verdict motion for a new trial presents the novel question whether to establish this offense the government must prove beyond a reasonable doubt that defendant knew the victim (i) had not attained the age of 16; and (ii) was four years younger than the defendant.
