COWIN, J.

Alfred Arcidi and the National Association of Government Employees, Inc. (NAGE), entered into a "consulting agreement" whereby Arcidi was to secure the approval of a proposed real estate development by the Massachusetts Turnpike Authority (MTA). The agreement provided that Arcidi would receive $250,000 provided that the development was "approved and built." Arcidi received $200,000 after the project was approved by MTA but was never paid the $50,000 balance...
