Defendant was charged, in a single-count indictment, with arson in the third degree arising out of a fire in a restaurant owned by him in the Village of Massena, St. Lawrence County. Local police officers spotted defendant and a vehicle resembling that driven by defendant in the immediate vicinity of the restaurant at the time of the fire. When two of those police officers went to defendant's home shortly thereafter to advise him that his business was aflame...
