The principal issue to be decided is whether, under the terms of the agreement of the parties, the state's involuntary partial taking of only a part of an interest in real property owned by the parties should be treated as a partial sale or total sale. On appeal, the plaintiffs, Dominick F. Farina, Joseph Farina, Theresa Raucci and Ann Brano, claim that the court improperly found the condemnation to be more akin to a partial sale.
