In February 2004, Nicholas Grigg was indicted on one count of possession of child pornography. See 18 U.S.C. § 2252(a)(4)(B). In accordance with a plea agreement, he pleaded guilty and was sentenced to 37 months' imprisonment and two years' supervised release. Mr. Grigg now challenges his sentence. He contends that the district court did not understand that it had the authority, post-Booker, to depart from the sentencing range...
