The defendant rear-ended the bus in which plaintiffs were passengers. At the time of the accident, defendant was driving a vehicle owned by a friend. The plaintiffs sued the defendant and his automobile insurer. The trial court granted summary judgment in favor of the insurer based upon a policy exclusion for bodily injury or property damage arising out of the use of any auto, other than an insured auto, which is available for the regular use of the insured...
