Petitioner, sentenced to 4½ to 9 years in prison following his 1993 conviction for criminal sale of a controlled substance in the third degree, was subsequently released on parole. While on parole, petitioner was arrested on September 15, 2000 on felony charges which ultimately resulted in his conviction on July 8, 2002 for criminal sale of a controlled substance in the fifth degree.
