Defendant was indicted and convicted of numerous offenses resulting from an incident that occurred on March 18, 2002, after the vehicle he was driving was stopped for a traffic violation. When Canajoharie Police Officer Cecil Jones asked defendant to exit the vehicle to take a field sobriety test, defendant revved the engine, grabbed a rifle that had been resting on the center console, fired a shot in Jones' direction, and sped away.
