SMITH, Chief Justice, for the Court:

¶ 1. Aires Chambliss was tried by a Jefferson County Circuit Court jury on two counts of aggravated assault. On count one, the jury convicted Chambliss of causing serious bodily injury to Demetrius Miller by throwing a foreign substance on Miller which resulted in second degree burns. Count two charged Chambliss with the same crime against Christopher Carradine. A directed verdict was granted on count two of aggravated assault...
