Ken Creviston ("Ken") filed a seven-count suit seeking compensatory and punitive damages from Aspen Products, Inc. ("Aspen") and William P. Biggins ("Biggins"). Ken's claims arose from a 1993 handwritten document ("Document") signed by Biggins and Bill Limbaugh ("Limbaugh"). Until Limbaugh died in 1994, Biggins and Limbaugh were business associates, equal owners of the corporate stock of Aspen, and officers and directors of Aspen.
