A jury convicted Jerry Lee Hood of cruelty to children, OCGA § 16-5-70(b), and aggravated battery, OCGA § 16-5-24, for shaking his one-month-old daughter so violently that serious brain injury resulted. The two offenses merged, and the trial court sentenced Hood to twenty years confinement.
