CAMPAIGN FIN. BD. v. SNYDER

10 Misc.3d 841 (2005)

804 N.Y.S.2d 662

NEW YORK CITY CAMPAIGN FINANCE BOARD, Plaintiff, v. GARY D. SNYDER et al., Defendants.

Civil Court of the City of New York, New York County.

November 21, 2005.

Attorney(s) appearing for the Case

Sue Ellen Dodell, Tara Malloy and Amy M. Loprest, New York City, for plaintiff.

Gary D. Snyder, defendant pro se, and Genova, Burns & Vernoia, New York City (Laurence D. Laufer and Jisha S. Vachachira of counsel), for Gary D. Snyder and another, defendants.

OPINION OF THE COURT

DIANE A. LEBEDEFF, J.

The primary and previously unanswered question present here is whether, under New York City's system of public financing of local election campaigns, a candidate and committee benefitting from public matching funds may be sued for the return of public funds where they utterly refuse to document that public funds were used for campaign purposes.
