Defendant Bienvenido Mejia ("Mejia") moves to exclude at trial evidence of his attempt, on November 4, 2000, to remove approximately $71,000 from the United States without declaring it to the United States Customs Service ("U.S.Customs"). Mejia also moves to exclude the prior trial testimony of coconspirator Victor Medina ("Medina"), who the Government asserts is unavailable to appear at Mejia's retrial...
