We deny the State's Motion for Rehearing, withdraw our previous opinion of November 30, 2004, and issue this substitute opinion reversing and remanding appellant's case. Appellant Banks was convicted of failing to register as a sex offender and received a twenty-five year prison sentence after the jury found that two enhancement paragraphs were true.
