THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. ANGEL M. CRUZ, Appellant.

Pursuant to a negotiated plea agreement, defendant pleaded guilty to rape in the third degree in satisfaction of a 12-count indictment and was sentenced to 10 years probation. County Court thereafter found that defendant willfully violated the terms of his probation, whereupon defendant's probation was revoked and a sentence of 11/3 to 4 years in prison was imposed.
