Defendant-appellant Domingo Mercedes Mercedes entered a guilty plea to a single-count indictment charging possession with intent to distribute one kilogram or more of heroin. See 21 U.S.C. § 841(a)(1). The district court sentenced him to serve a 120-month incarcerative term—the mandatory minimum for such an offense. See id. § 841(b)(1)(A)(i). This appeal followed.
