Petitioner is serving concurrent prison terms of 25 years to life and 7½ to 15 years imposed after his conviction in 1978 of murder in the second degree and manslaughter in the second degree for the shooting death of the owner of a grocery store during a robbery. Petitioner reappeared before the Board of Parole in July 2003 and his request for parole release was denied. Following an unsuccessful administrative appeal, petitioner commenced this CPLR article 78 proceeding...
