In May 1982, petitioner and an accomplice were involved in the gunpoint robbery of a restaurant which resulted in petitioner's conviction of two counts of robbery in the first degree and one count of robbery in the second degree. Shortly thereafter, in June 1982, petitioner and three accomplices robbed the restaurant's owner and, during the robbery, the owner was killed.
