OPINION

IRENAS, Senior District Judge.

Currently before this Court is Plaintiff's Motion for Reargument of the Court's Order dated October 12,1 2004.2 For the reasons set forth below, the Court will grant Plaintiff's motion, vacate the Order of October 12, 2004, and deny Defendants' motion to dismiss Plaintiff's state law claims.
