THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. ARCHIE CHATMAN, Appellant.

Ordered that the judgment is reversed, on the law and as a matter of discretion in the interest of justice, and a new trial is ordered.

The defendant failed to preserve for appellate review his contention that the evidence was legally insufficient to establish his guilt of criminal contempt in the first degree and criminal contempt in the second degree beyond a reasonable doubt. We decline to exercise our interest of justice jurisdiction to dismiss those charges....
