At approximately 10:15 P.M. on April 25, 2003, a passing motorist noticed a pickup truck at a 45-degree angle in a ditch along a rural road. As the motorist pulled alongside the truck, she observed defendant sitting in the driver's seat, with the engine running, attempting to drive the truck out of the ditch.
