ROBERT HOTHAN, Respondent, v. METROPOLITAN SUBURBAN BUS AUTHORITY et al., Appellants.

Appellate Division of the Supreme Court of the State of New York, Second Department.

January 24, 2005.

Ordered that the judgment is modified, on the law, by deleting the provision thereof awarding interest at the rate of 9% per annum and substituting therefor a provision awarding interest at the rate of 4% per annum; as so modified, the judgment is affirmed, without costs or disbursements, and the matter is remitted to the Supreme Court, Nassau County, for entry of an appropriate amended judgment.
