In this interlocutory appeal filed by the United States we must interpret for the first time for this court the meaning of "testimonial evidence" as used in the Supreme Court's recent decision in Crawford v. Washington, 541 U.S. 36, 124 S.Ct. 1354, 158 L.Ed.2d 177 (2004), and determine its application to legally obtained wiretap evidence and evidence of conversations...
