Timothy D. Klaus (Movant) appeals from the motion court's judgment denying his Rule 24.035 motion for post-conviction relief (motion) without an evidentiary hearing. Pursuant to a plea agreement with the State, Movant pled guilty to: 1) one count of third-degree misdemeanor domestic assault, in violation of Section 565.0741
