In the district court, the plaintiff Bernabé Tejada Batista ("Tejada") recovered damages against two of his superiors in the Puerto Rico Justice Department ("PRJD") for instigating Tejada's discharge in violation of his First Amendment rights. The underlying events are easily described; the complications arise out of governing legal doctrine.

In 1987, Tejada began working as a law enforcement agent in the Special Investigations Bureau...
