Plaintiff-Appellant Jeanina Celestine ("Celestine") began this action on September 3, 2002 by filing a summons in the New York State Supreme Court, Westchester County. In her summons, she indicated that she was seeking damages arising out of negligence and malpractice on the part of Mount Vernon Neighborhood Health Center ("Mount Vernon"), where she had been a patient.
