NORMAN v. U.S.

No. CIV.A.04-1208(EGS).

377 F.Supp.2d 96 (2005)

John D. NORMAN Plaintiff v. UNITED STATES, et al., Defendants.

United States District Court, District of Columbia.

July 11, 2005.

Attorney(s) appearing for the Case

John Sanford Kearns, Saiontz, Kirk & Miles, P.A., Baltimore, MD, for Plaintiff.

Beverly Marie Russell, U.S. Attorney's Office, Washington, DC, for Defendants.

MEMORANDUM OPINION

SULLIVAN, District Judge.

Pending before the Court is plaintiff John D. Norman's Motion to Reconsider and Reinstate his civil action for damages under the Federal Tort Claims Act ("FTCA"). Because the Court is persuaded that reinstatement would ultimately be futile given plaintiff's failure to exhaust his FTCA administrative remedies within the congressionally mandated limitations period, plaintiff's motion will be DENIED.
