LEON, District Judge.

Lieutenant Commander ("LCDR") Douglas Mueller, the plaintiff in this action, is an active duty member of the Navy. He brings this action against the Department of the Navy ("Navy") and Gordon England, the Secretary of the Navy ("England" or "the Secretary"), to correct his military record and to convene a special selection board ("SSB").
