Appellant pleaded nolo contendere to two counts of first-degree sexual abuse, and was sentenced to five years' probation and fined $5,000. The Van Buren County Circuit Court revoked the probation, and appellant was sentenced to ten years' imprisonment. Appellant subsequently filed a petition for writ of habeas corpus in the Jefferson County Circuit Court, arguing that he was improperly sentenced to ten years.
