RenCare, Ltd. appeals the judgment dismissing its tort claims against Southwest General Hospital, L.P.; Southwest's parent and operator, IASIS Healthcare Corporation; and United Medical Resources, Inc. for lack of subject matter jurisdiction. We hold the trial court possessed subject matter jurisdiction over RenCare's claims because they do not "arise under" the Medicare Act. We therefore reverse the trial court...
