Appellant Marie Joseph Franco Boulle ("Franco") brings five issues, challenging the summary judgment entered against him and in favor of his brother, appellee Jean-Raymond Boulle ("Jean").1 We conclude the trial court incorrectly granted summary judgment on Franco's breach of contract, fraud, and rescission claims.
